The pain of many graduates, especially doctoral students, is typically academic and abstract knowledge, which is difficult to translate into concrete solutions in reality. Graduates often can not dynamically and smoothly enter the career path, due to the lack of valuable experience.

Grinding theoretical skills is a necessary basis, but so far there was no connecting element between knowledge acquired during studies and the skills needed to carry out these assumptions in everyday practice resulting from the specificity of a given profession. Therefore, legal tools have been sought for a long time, which will enable them to acquire reliable textbook knowledge, while giving the opportunity to apply it in demanding reality. The answer to this need was the implementation doctorate.

What is an implementation doctorate and what is it about?

The concept of implementation doctrine and its principles have been regulated in the Regulation of the Minister of Science and Higher Education of April 28, 2017. The Ph. D. is a program that allows to combine research work with real performance of duties for a specific entity operating in a given industry (PhD student must be employed entrepreneur or public administration body full time). As the name suggests, the project aims to “implement” the effects of research in practice. The addressees of the first edition of the program are people starting doctoral studies in the academic year 2017/2018 (there is no guarantee that recruitment to the program will take place every year). It does not matter if the candidate has taken one or more fields of study. The program may be implemented as part of the already undertaken path of academic education or as separate studies. According to the program assumptions, the recruitment will be selected through a competition of 500 PhD students who will be authorized to receive a monthly government scholarship in the amount of PLN 2,450.00 (an additional source of income will be the remuneration received from the employer).

How to join the implementation drama?

Individual universities in the recruitment to the implementation doctorate apply the conditions in force in the given unit and the recruitment procedure prescribed for doctoral studies as such. On behalf of the doctoral student, the application together with full documentation is submitted by the home university or the research institute or the State Academy of Sciences. The ministerial team appointed to evaluate the documentation submitted by the candidates and to select the beneficiaries of the program, will take into account the individual achievements and academic achievements of the ambitious young scientists. The team will also assess the scientific or artistic level of the attached works, as well as the usefulness, purposefulness and innovativeness of the planned projects, due to the scientific and economic development or the development of individual art disciplines. Declared projects must therefore be justified by a clear need or niche in a specific matter, which requires the solution or improvement of existing solutions. The goal of the PhD thesis is to submit a valuable dissertation in terms of content and practicality. The work should be of a progressive nature supported by comprehensive basic knowledge.

Employer’s responsibilities and the issue of copyright

Obvious obligation of the employing entity is to pay remuneration, but the employer should also appoint a PhD student as an assistant supervisor who will look after and assist in the work undertaken by the doctoral student. The assistant supervisor, according to the provisions of the Act, may be a person who:

holds a doctorate degree;

has at least five years of experience in research and development work or significant achievements in the development and implementation in the economic or social sphere of an original design, construction, technology or artistic solution of a supralocal scope, and durable and universal character.

The crucial issue is the situation in which, as part of the implementation doctoral the young scientist will develop an innovative solution, technology or construction that the employer would be willing to implement permanently in his company. Then, first of all, consider the copyright to the results of the PhD student’s research. The general provisions in the field of copyright apply here, because the legislator has not regulated separately the copyright related to the goods obtained as a result of the implementation program. Subsidies should also refer to the provisions of labor law due to the employment relationship between the doctoral student and the entrepreneur.

As a rule, if the law or employment contract does not provide otherwise, the employer whose employee created the work (construction, technology, solution, finished product, etc.) as a result of the performance of duties from the employment relationship, acquires, at the time of accepting the work, proprietary rights in limits arising from the purpose of the employment contract and the parties’ consistent intentions. This necessitates the detailed determination by the parties, immediately before the start of cooperation, of the distribution of personal and property rights, and the possible participation of the doctoral student in profits. This is particularly important when the employer intends to adapt and apply solutions worked out by the PhD student in the future (this also applies to, among others, possible sale of rights, patent applications, establishment of a spin-type company, etc.).

At the same time, it should be noted that a young scientist, with the completion of doctoral studies or the end of cooperation with a given company, does not automatically recover the proprietary copyrights. It can, however, regain property rights to the dissertation, if the employer does not undertake to disseminate it within the time prescribed by law. A person who successfully completes the PhD thesis has two paths to choose from: he can pursue a scientific career or pursue a social, economic or artistic activity.

The importance of the implementation doctorate

The idea of ​​the program is to strengthen and systematize cooperation between the scientific and socio-economic environment. Through implementation drills, enterprises can gain valuable, creative and qualified employees. For people undertaking doctoral studies, it is an opportunity to gain work experience in a way that does not break with the course of academic classes. Therefore, there is a mutual advantage. How the program will work and what its effects will be in reality will show time.
